I, hereby acknowledge and agree to the following terms and conditions in consideration for my participation in the ice bath class, which includes breath work and cold exposure in tubs of ice (the "Activity"): 1. Assumption of Risks: I understand and acknowledge that the Activity involves certain inherent risks and dangers, including but not limited to the risk of injury, hypothermia, and other adverse health effects. I am voluntarily participating in this Activity with full knowledge of the risks involved. 2. Physical Fitness and Health: I hereby affirm that I am in good physical condition and do not suffer from any medical condition that might in any way hinder or prevent my participation in the Activity. If I have any concerns about my health or fitness, I have consulted a physician before participating in the Activity. 3. Safety Guidelines: I agree to abide by all safety guidelines and instructions provided by the instructor(s) conducting the Activity. I understand that failure to do so may result in my removal from the Activity without refund. 4. Waiver of Liability: I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, discharge, and hold harmless Ice Cold Club, their respective officers, directors, employees, agents, and representatives from any and all claims, demands, causes of action, liabilities, costs, expenses, or judgments, including attorney's fees and court costs, arising out of my participation in the Activity. 5. Medical Emergencies: In the event of a medical emergency, I authorize any qualified medical personnel to provide necessary medical treatment and agree to be responsible for any associated costs. 6. Photo and Video Release: I hereby grant permission to Ice Cold Club to use photographs and/or videos of me taken during the Activity for promotional, marketing, or educational purposes without compensation. 7. Governing Law: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of laws principles.
